It was a tough decision to be made and we just felt like all the evidence or lack of evidence had been presented. The jury should have a reasonable doubt.

There was only one verdict slip that went out to the jury, but he was convicted of two counts of first degree murder. So, that's an issue as well as the change of venue and all of the other issues that we had raised before.

It absolutely could be appeal grounds. The cases we cited say you can't cure it and it's reversible error not to grant a mistrial.
