Sometimes juries think the judge is part of the government.

The longer the jury is out the worse it is for the defense. If the government doesn't have the evidence then the jury can come to a decision relatively quickly.

The SEC would have to give them a waiver.

As I understand the law, all the jury has to do is find is that somebody at Andersen engaged in illegal conduct. They don't have to be unanimous as to who at Andersen is the agent.

We're not yet at that point [for a dynamite charge]. They are still talking and not killing each other.

I'm not sure this is a linchpin. He will have to point a finger at a much larger control group at Andersen before they can knock out the entire firm.
