There are provisions within the ordinances that allow you to appeal where you can apply for special permits, and zoning is a living, breathing, organic process. Zoning isn't written to last a century. So as communities change, zoning can change as well.

They can't win no matter which way they turn, because the ordinances don't allow them to do anything in their present location. And if you have the capacity to keep more than six people -- regardless to the number who are living there -- you are considered over the limit. I counted five bedrooms, so that means they have the capacity for 10 residents. If they have seven bedrooms, they could have 14.

It does repeal a whole variety of special ordinances. This is always a good thing to do because our city code is used within the city and outside.

That's why we have zoning.

If the special use (zoning) only applied to one specific plot ... then it would be called spot zoning and could be attacked in court.
