An American citizen should be able to speak out against their public officials when they have a concern. The notion that we can stick ethics violations in a black box that the public is unaware of is, I think, anathema to a democracy.

The modern view of criminal justice, broadly, is that public concern with morality or expediency decrees expiation for the violation of a norm; this concern finds expression in the infliction of punishment on the evil doer by agents of the state, the evil doer, however, enjoying the protection of a regular procedure.

It is a great source of concern when any of these procedures are not being followed. One is always going to find a violation here or there, but an indication that ignoring the rules is widespread practice is shocking and deplorable.
